Definitely fair.

A devil fruit is a cursed fruit that gives people a super power but takes away their capacity to swim. They're cursed to drown in ocean, but a lot of people consider the power worth the exchange. Even fishman can eat one, but since they can't swim either afterwards, I assume most of them avoid them even more than anyone else.
